1. Application of the General Sales Conditions
1.1 All orders placed on the Lindegger et Fils SA Internet sales site are governed by these General Terms and Conditions of Sale – which are an integral part of the contract and apply to the exclusion of all other conditions. By placing an order you acknowledge having read, understood and accepted, without any reservation, the present General Conditions of Sale.
1.2 By using this website, you also agree to be bound by the legal notices on the Lindegger & Sons Ltd. website, including the provisions on the protection of personal data. Lindegger et Fils SA encourages you to read them carefully before using the services provided on this site.
1.3 You are informed that your personal data will be processed by Lindegger et Fils SA in accordance with Swiss data protection legislation. For certain data processing operations, Lindegger et Fils SA may commission third parties to comply with the same legislation.
1.4 Lindegger et Fils SA reserves the right to amend these Terms and Conditions at any time by posting a new version on the Lindegger et Fils SA website. Each order placed after the publication by Lindegger et Fils SA of the new version of its General Terms and Conditions of Sale constitutes acceptance of the latter.
2. Registration on the website of Lindegger & Fils SA
2.1 By registering on the Lindegger et Fils SA website, you confirm that the information you provide is accurate and complete.
2.2 Please inform Lindegger & Sons Ltd. of any changes to the personal data you have provided.
3. Password
3.1 You must define a password when registering on the Lindegger & Fils SA website. This password is strictly confidential and must not be disclosed to third parties.
3.2 You are fully responsible for the use of your password and for all orders that are placed, also without your knowledge, using this password.
3.3 If you know or suspect that a third party knows or uses your password, you must immediately inform the customer service department of Lindegger & Son Ltd.
4. Commands
4.1 By placing an order on this site, you agree to purchase the products you have selected in accordance with these Terms and Conditions and to pay the price.
4.2 Orders placed by you with Lindegger et Fils SA on this site are subject to maximum quantity limits. The maximum quantity per product ordered is 10 units.
4.3 Lindegger et Fils SA offers its products for sale on this website while stocks last.
4.4 Only persons of legal age may place orders on this site.
4.5 Contact Lenses: By confirming your order, you warrant the following:
4.5.1 You only order contact lenses that have been previously prescribed by a contact lens specialist (eye doctor or qualified optician) and are well tolerated. Your optician Lindegger et Fils SA recommends an annual check-up for optimal wearing safety.
4.5.2 You have your lenses checked regularly by a specialist and that no contraindications to wearing contact lenses have been found.
4.5.3 You comply with the prescribed duration of lens wear.
4.5.4 You are familiar with and fully comply with your contact lens specialist’s instructions for lens care and handling. If in doubt, please contact your lens specialist.
4.5.5 You immediately stop wearing contact lenses if complications arise and immediately seek examination by an ophthalmologist or your licensed optician.
4.5.6 You release Lindegger et Fils SA from any liability for any possible damage caused by wearing contact lenses or lack of tolerance to the products and, in particular, in case of damage to health. You also release Lindegger & Fils SA from any liability for the use of products that are not in accordance with the manufacturer’s instructions or the prescriptions of your ophthalmologist or qualified optician.
4.5.7 You will not sue Lindegger & Sons Ltd. for complications, disorders, other problems and product liability, but will address yourself directly and exclusively to the manufacturer. It is your responsibility to inquire about warranty details directly with the manufacturer.
5. Recurring Lens Order Service
5.1 If you wish, you may opt for the recurring lens order service. It allows you to receive automatically your products previously selected by you (lenses and/or cleaning products) and according to the frequency that you will have defined.
5.2 In case of insolvency, we will suspend delivery until we receive your payment.
5.3 You can change the date of the next shipment or cancel this service at any time.
5.4 You can take advantage of promotions specifically compatible with this option. However, the recurring order service does not allow you to automatically benefit from other offers and promotions. In order to benefit from it, we recommend that you place an order separately.
6. Confirmation of order
6.1 An order placed by you on this website will be processed when it is confirmed by an e-mail from Lindegger et Fils SA.
6.2 Lindegger et Fils SA reserves the right to refuse an order without giving reasons.
6.3 The data recorded by Lindegger et Fils SA constitutes irrefutable proof of the order or transaction. The data recorded by the payment system constitutes irrefutable proof of the financial transaction.
7. Awards
7.1 The prices payable for the goods you order are those shown on this site at the date of the order, including VAT but excluding delivery charges.
7.2 Prices are quoted in Swiss francs (CHF) and include VAT.
7.3 The prices of time-limited offers are only valid during the period indicated.
7.4 Lindegger et Fils SA reserves the right to change its prices and delivery charges at any time, however, increases do not apply to current orders.
8. Delivery
8.1 All orders confirmed by Lindegger et Fils SA will be delivered to the address indicated on the order.
8.2 Delivery costs are charged at the rates indicated on the Lindegger et Fils SA sales website on the date of the order and are calculated in particular according to the amount of the order and the delivery method chosen.
8.3 Lindegger & Sons Ltd. shall make every effort to ensure delivery within ten working days of receipt of a unit order. This 10 days delay is given as an indication, not contractual.
8.4 Deliveries may only be made within Switzerland.
9. Payment
9.1 The payment of the price of the goods is made by credit card or debit card at the time of the order.
9.2 Your credit card details are encrypted for security reasons and are not stored by Lindegger & Son Ltd.
9.3 The delivered goods remain the property of LINDEGGER ET FILS SA until full payment has been received.
10. Verification of the goods
10.1 It is your responsibility to check the quantity and condition of the goods upon delivery and to notify Lindegger et Fils SA of any damage or discrepancies between the product sent and the product ordered within 7 working days.
11. Return of goods
11.1 It is possible to request an exchange of a product or a refund against return of the goods (except for glasses with optical lenses, see conditions in paragraph 11.8).
11.2 For sunglasses, the goods must be returned in their original, unused condition and in their original packaging (with accessories). The return period is 7 days after the date of receipt of the goods.
11.3 For lenses, the goods must be returned only in their original packaging and only if they have not been opened or damaged. The return period is 7 days from the date of receipt of the goods.
11.4 Products purchased on sale as well as gift cards can neither be returned nor exchanged.
11.5 When returns have been made in the prescribed manner, Lindegger et Fils SA will make every effort to refund the price of the returned goods within 15 days of the date of receipt of the returned goods.
11.6 For the returned goods, the delivery costs fixed in the order remain at your charge and the risks related to the return are at your charge.
11.7 In the case of a return of goods to the central office directly, the shipping costs for the return of the goods are at your expense. To avoid these costs, you can return the goods yourself to a Lindegger & Sons Ltd. store.
11.8 Glasses with optical lenses are not returnable. An agreement with the store is always possible within the 7-day return period after the date of receipt of the goods. However, 50% of the purchase price of the glasses will be retained. The goods must be in their original, unused condition and in their original packaging (with accessories). The exchange period is 7 days from the date of receipt of the goods.
12. Warranty for defects
12.1 Eyeglasses, optical lenses, sunglasses and contact lenses are guaranteed against any manufacturing defect for a period of 2 years from delivery according to the conditions indicated for each product. Defective goods will be returned or exchanged. The defect report must be made at a Lindegger & Sons Ltd. store. This warranty excludes and replaces the statutory warranty provisions for defects. The warranty for defects is neither renewable nor extendable in case of exchange of goods.
14. Limitation of liability
14.1 Lindegger et Fils SA assumes no liability for product deviations or minor omissions from the photos or text on this website.
14.2 In no case, the non-delivery of products will give rise to a refund greater than the amount of the purchase price of the products. No claim for damages shall exceed this amount. IN NO EVENT SHALL LINDEGGER ET FILS SA BE LIABLE FOR ANY CONSEQUENTIAL DAMAGES ARISING IN CONNECTION WITH ITS PRODUCTS, THEIR USE, OR THEIR SALE ON THIS SITE.
15. Circumstances beyond the control of Lindegger
15.1 Lindegger et Fils SA shall use its best efforts to fulfill its obligations, but shall not be liable for delays or non-delivery due to circumstances beyond its control, such as strikes, wars, natural disasters or other events that prevent the production, transportation or delivery of products.
15.2 In the event of a delay, Lindegger et Fils SA shall fulfill its obligations as soon as possible and reserves the right to distribute remaining stocks of products among its customers in an equitable manner.
16. Applicable law and jurisdiction
16.1 The present General Terms and Conditions of Sale are governed by Swiss law.
16.2 Any dispute arising from the interpretation, application or execution of these terms and conditions shall be subject to the exclusive jurisdiction of the courts of the Canton of the registered office of Lindegger & Sons Ltd, subject to mandatory legal provisions and the right of appeal to the Federal Court.
